Keith,

It was proposed to the states for ratification by the 38th Congress on January 31, 1865, but then it had to be ratified by 3/4 of the states, as mandated by Article VI of the US Constitution. On December 18, 1865, the Secretary of State certified that this had occurred and the 13th Amendment became part of the United States Constitution.
